Disclaimer

1. Scope of this disclaimer

This disclaimer applies to the public Website and to trading-related Software and technical Services provided by TWOFOX Limited through twfx.dev. It explains the limits of the information, Software and Services provided by TWOFOX Limited. It does not amend an agreed Project scope, warranty, liability provision or other term of a Project. Those matters are governed by the applicable Business Terms and any Project-specific agreement.

2. Website information

The Website is provided for general information about TWOFOX Limited and its software-engineering and technical-consultancy Services. Information on the Website may be incomplete, change over time or not be suitable for a particular purpose or circumstance. It should not be relied on as the basis for a trading, investment, commercial, legal, tax, regulatory or other decision without independent consideration and, where appropriate, professional advice.

An enquiry, discussion or information published on the Website does not create a contract for Services. A Project is undertaken only on the terms agreed between TWOFOX Limited and the Client.

3. No investment, trading or financial advice

TWOFOX Limited is a software-development and technical-consultancy business. It is not a broker, investment manager, financial adviser or trading adviser. Neither the Website nor the Services constitute investment, trading, financial, legal, tax or regulatory advice, or a recommendation to buy, sell, hold or trade any financial instrument, use a particular broker or platform, or follow a particular strategy.

Where TWOFOX Limited implements, automates, translates, modifies or connects a Client's strategy, rule set or workflow, that work does not mean that TWOFOX Limited has assessed, approved, endorsed, recommended or validated it. The Client is responsible for its own trading and investment decisions and for obtaining any advice it considers necessary.

4. Software, specifications and trading performance

Software may be developed to meet an agreed Project specification. Whether Software conforms to that specification is distinct from whether a strategy, methodology or trading decision produces a particular financial outcome. TWOFOX Limited does not represent or warrant that Software will be profitable, prevent or reduce losses, improve trading performance, or achieve a particular result.

The Website does not publish technical examples, backtests, case studies, testimonials or performance claims. If TWOFOX Limited decides to publish any such material, this disclaimer and the Risk Disclosure will require review before publication.

5. Third-party systems and availability

Software may depend on or interact with systems outside TWOFOX Limited's control, including trading platforms, brokers, exchanges, market-data providers, operating systems, APIs, third-party libraries, networks and computing infrastructure. Those systems may be unavailable, altered, deprecated, restricted, delayed, inaccurate or incompatible with the Software. Changes to them, or to market rules, account permissions or data formats, may affect the Software's operation, availability or results.

Where an agreed Project includes help with deployment, configuration or integration, that assistance does not transfer responsibility for the Client's accounts, credentials, third-party contracts, trading decisions or operational controls to TWOFOX Limited. The Client remains responsible for deciding whether the Software is suitable for its intended use and, where relevant, for appropriate testing, monitoring, access management, limits, contingency arrangements and procedures to suspend or stop trading, subject to the agreed Project scope.

6. Live and automated use

Software may be used in live trading or automated order routing where that is within the agreed Project scope. Such use can involve, among other things, orders being submitted, amended, duplicated, rejected, delayed or filled at an unexpected price; configuration or integration errors; loss of connectivity or market data; and interruptions or changes in third-party systems. Testing, review, simulation and paper trading can reduce some risks but cannot eliminate them or reproduce every live condition.

The Client is responsible for authorising live use and for its operation once deployed, including its account settings, credentials, monitoring and risk controls, subject to the agreed Project scope. TWOFOX Limited does not assume responsibility for the Client's trading activities, profit, loss or missed trading opportunity merely because Software has been developed, configured, deployed or supported for a Project.

Nothing in this disclaimer excludes or limits a liability that cannot lawfully be excluded or limited. Any agreed Project-specific obligations of TWOFOX Limited, including the applicable limitations and exclusions of liability, are set out in the Business Terms and the relevant Project agreement.

This disclaimer should be read with the Risk Disclosure, which describes market and automated-trading risks, and the Website Terms, which govern use of the Website.
