Risk Disclosure¶
1. Scope of this disclosure¶
This disclosure applies to the trading-related Software and technical Services provided by TWOFOX Limited through twfx.dev. It should be read by anyone considering or using Software developed for a trading-related Project.
twfx.dev is a portal for engaging TWOFOX Limited's software-development and technical-consultancy Services for private Projects. It is not a trading service, broker, investment manager or financial adviser. This disclosure is not a recommendation to trade, invest, open an account or use any particular market, broker, platform, strategy or Software configuration.
This disclosure explains important market and technical risks. It does not amend the agreed scope, warranties, liability provisions or other terms of an individual Project. Those matters are governed by the applicable Business Terms and any Project-specific agreement.
2. No investment, trading or financial advice¶
TWOFOX Limited does not provide investment, trading, financial, legal, tax or regulatory advice through twfx.dev, the Services or the Software. Information about markets, platforms, techniques, strategy logic or Software functionality is provided only in the context of software development and technical consultancy.
Where a Client asks TWOFOX Limited to implement, automate, translate, modify or connect a strategy, rule set or trading workflow, that work does not mean that TWOFOX Limited has assessed, approved, endorsed, recommended or validated it. The Client must obtain any professional advice it considers necessary before making trading or investment decisions.
3. Trading involves substantial risk of loss¶
Trading in financial markets involves substantial risk and is not suitable for everyone. Prices may move rapidly and unpredictably. A Client may lose some or all of the capital committed to trading and, depending on the product, account terms and use of leverage, may incur losses exceeding the amounts initially committed.
The risks may arise in relation to, among other things, futures, options, foreign exchange, contracts for difference, spread betting, securities, cryptocurrencies and other exchange-traded or over-the-counter products. The nature and level of risk depends on the relevant market, instrument, broker or exchange arrangements, leverage, liquidity, volatility, position size and the Client's own circumstances.
The Client is solely responsible for its trading and investment decisions, risk assessment, capital allocation, account settings and compliance with laws or rules that apply to its activities. The availability of twfx.dev worldwide does not mean that any particular Service, Software configuration or trading activity is suitable, lawful or available in every location.
4. No performance assurance¶
Software functioning in accordance with an agreed specification is different from a strategy, methodology or trading decision producing a particular financial result. TWOFOX Limited gives no assurance that the use of Software will be profitable, avoid losses, improve performance or achieve any particular result.
The Website does not publish hypothetical results, backtests, performance examples or testimonials. If TWOFOX Limited later decides to publish any such material, this disclosure will need to be reviewed and updated before publication.
Past performance, where it is discussed by a Client or appears in Client-provided material, is not a reliable indicator of future results. Backtesting, simulation and paper trading cannot reproduce every condition of live trading and should not be treated as evidence that a strategy will perform as expected in live markets.
5. Live trading and automated execution¶
Software delivered for a Project may be used in live trading or automated order routing if that is within the agreed scope. Live and automated use introduces particular risks, including:
- orders being submitted, amended, duplicated, rejected, delayed, partially filled or filled at an unexpected price;
- slippage, gaps, illiquidity, volatility, exchange or broker controls, trading halts and changes to market conditions;
- incorrect or incomplete configuration, parameter selection, symbol mapping, account selection, position handling or risk limits;
- logic, data, timing, arithmetic, integration or operational errors in the Software or in a system with which it interacts;
- loss of connectivity, power, market data, platform availability, API access, credentials, server capacity or other infrastructure; and
- delays in detecting, responding to or stopping an unwanted automated action.
Testing, review, simulation and paper trading can reduce some risks, but cannot eliminate them or reproduce all live conditions. Before using Software in a live environment, the Client is responsible for deciding whether it has carried out appropriate testing and whether it has suitable controls, monitoring, access management, account limits, contingency arrangements and procedures for suspending or stopping trading.
6. Third-party systems and dependencies¶
Software may depend on trading platforms, brokers, exchanges, market-data providers, operating systems, APIs, networks, cloud or hosting infrastructure, third-party libraries and other services outside TWOFOX Limited's control. Those systems may be unavailable, altered, deprecated, restricted, delayed, inaccurate or incompatible with the Software.
Changes in a third-party system, market rules, account permissions or data format may affect the operation, availability or results of the Software. The Client remains responsible for its accounts, credentials, third-party contracts and the suitability of any third-party system it chooses to use, subject to the agreed Project scope.
7. Related documents¶
This disclosure should be read with the Disclaimer, which explains the limits of public information and the no-advice position, and the Business Terms, which govern commissioned Services and Project-specific contractual obligations.
